Please read this Privacy Policy (this “Privacy Policy”) carefully. MasterHealth Technologies Inc. and its affiliates (collectively, “MasterHealth”, “we,” “us,” or “our”) provide programs and services including via our mobile applications (the “App”) and our website (the “Website”) designed to help you build healthy habits based on your unique goals (the “Services”). The Services include your access or use of the App and Website including guided health programs (“Paid Programs”) and challenges (“Challenges” or a “Challenge”) that may be made available via the App and/or Website individually and collectively, the “Platform”) and content, information, interactive features, tools, and/or downloads that MasterHealth owns, controls, or otherwise makes available via the Platform, and the functionality we make available to you through the Platform.


You (“User”, “you”, “your”) expressly consent to the terms of this Agreement including by your use of or access to the Services, use of our Platform, downloading of the App, or agreement to the Service Terms at an app store such as the Apple App Store or Google Play before downloading the App. If you do not consent to these Service Terms, please do not access or use the Services.


What does this Privacy Policy cover?


Your privacy is important to MasterHealth, and MasterHealth intends to carefully manage the personal information (including personally identifying information) you provide to us or which we collect in the course of providing the Services and as further described below (“Personal Information”) This Privacy Policy describes the information practices of MasterHealth, including what type of information is collected, used, and disclosed by us, how the information is used, and with whom the information is shared.


We gather various types of Personal Information from our users (“Users”), as explained in more detail below, and we use this Personal Information in connection with our Services. As further described below, we use it to provide our Services, to personalize and improve our Services, to allow you to set up a user account and profile, to allow you to post ratings and reviews of the Services, to contact you and allow other users to contact you, to fulfill your requests for Services, and to analyse how you use the Services. In certain cases, we may also share some Personal Information with third parties, but only as described below.


Will we ever change this Privacy Policy?


We are constantly trying to improve our Services, so we may need to change the Privacy Policy from time to time as well. We will alert you and other Service users (individually and collectively, “Users”) to changes by posting the revised Privacy Policy on the Website and changing the “Last Revised” date at the top. It is your responsibility to check the Website periodically and review the Privacy Policy. You are bound by any changes to the Privacy Policy when you use the Platform or Services after such changes have been posted. Use of personal information we collect is subject to the Privacy Policy in effect at the time such information is used.


What personal information we collect and how it is collected


Information You Provide To Us. We receive and store Personal Information you provide to us. For example, through the registration process and/or through your account settings, we may collect Personal Information such as your name, email address, phone number, password, and photo. We may collect Personal Information when Users use the Services and/or use the Platform, interact with the Platform, use any aspects of our Services or otherwise contact us.


Health and Fitness Information. Your health and fitness information is important to providing you with the Services. We collect this type of information. Examples are your past, present and future physical or mental health or condition, fitness level, User’s weight, blood glucose, blood pressure, health indicators and similar information about your condition, and personal information you provide us including via the App.

 

Demographic and Location Information. MasterHealth may collect and process demographic information from or about User at the Website and the App from time to time, such as information about User’s gender, age, country, and postal or zip code (“Demographic Information”). MasterHealth may collect this information through various forms and in various places on the Platform, including account registration forms, contact forms, or when User otherwise interacts with the Platform. We may also collect location information if this is enabled on your mobile device. If you tell us where you are (e.g., by allowing your mobile device to send us your location), we may store and use that information to provide you with location-specific Services. If you want to deactivate this feature, you can deactivate GPS (global positioning system) on your mobile device.


Device and Information Collected Automatically

MasterHealth and MasterHealth’s third-party service providers may use a variety of technologies that automatically (or passively) store or collect certain information whenever User visits or interacts with the Platform (“Usage Information”). This Usage Information may be stored or accessed using a variety of technologies that may be downloaded to User’s personal computer, browser, laptop, tablet, mobile phone or other device (a “Device”) whenever User visits or interacts with MasterHealth’s Website and/or the App. This Usage Information may include: User’s IP address, UDID or other unique identifier (“Device Identifier”) (a Device Identifier is a number that is automatically assigned to User’s Device used to access the Platform, and MasterHealth’s computers identify User’s Device by its Device Identifier); User’s Device functionality (including browser, operating system, hardware, mobile network information); User’s subscription level; the URL that referred User to MasterHealth’s Platform; the areas within MasterHealth’s Platform that User visits and User’s activities there, including remembering User, User’s preferences and pages User requested and/or viewed; User’s Device location; User’s Device characteristics; and certain other Device data, including the time of day, among other information.


Other information collected automatically may include your IP address, location details, “cookie” information, mobile device, operating system, the type of browser, demographic information, application and/or device(s) you’re using to access our Services, click-through paths, the identity of the page or feature you are requesting or interacting with, time on page of feature, and other indicators of how you are interacting with the Services. “Cookies” are identifiers we transfer to your device that allow us to recognize your browser, application or device and tell us how and when various pages and features in our Services are visited or used and by how many people. You may be able to change the preferences on your browser, application or device to prevent or limit your device’s acceptance of cookies, but this may prevent you from taking advantage of some of our features.


We may deliver a file to you through the Services (known as a “web beacon”) from an ad network. Web beacons allow ad networks to provide anonymized, aggregated auditing, research and reporting for us and for advertisers. Web beacons also enable ad networks to serve targeted advertisements to you when you visit other websites. Because your web browser must request these advertisements and web beacons from the ad network’s servers, these companies can view, edit, or set their own cookies, just as if you had requested a web page from their site.


We may also use an embedded script, programming code that is designed to collect information about User’s interactions with the Platform and Services, such as the links User clicks on. The code is temporarily downloaded onto User’s Device from MasterHealth’s web server and/or App or a third party service provider, is active only while User is connected to the Platform, and is deactivated or deleted thereafter.


We may also use ETags (or entity tags), a feature of the cache in browsers. It is an opaque identifier assigned by a web server to a specific version of a resource found at a URL. If the resource content at that URL ever changes, a new and different ETag is assigned. Used in this manner ETags are a form of Device Identifier.


MasterHealth may use the tracking technologies described above (“Tracking Technologies”) for a variety of purposes, including:


MasterHealth may use cookies or other Tracking Technologies that MasterHealth considers is strictly necessary to allow User to use and access MasterHealth’s Platform and Services, including cookies required for system administration, to prevent fraudulent activity, or to improve the Services.


MasterHealth may use cookies or other Tracking Technologies that are useful in order to assess the performance of the Platform and Services, including as part of MasterHealth’s analytic practices or otherwise to improve the content, products or services offered through the Platform and Services.


MasterHealth may use cookies or other Tracking Technologies that are required to offer User enhanced functionality when accessing the Platform , including identifying User when User sign in to MasterHealth’s Platform or keeping track of User’s specified preferences, including in terms of the presentation of content on MasterHealth’s Platform.


Our third party partners, including advertising partners may also use web beacons, or transmit cookies to and read cookies from your browser, application or device when you visit or use our Services. Also, if you click on a link to a third party website or service, such third party may also transmit cookies to you. This Privacy Policy does not cover the use of cookies by any third parties.


There may be other Tracking Technologies now and later devised and used by MasterHealth in connection with the Platform and Services. Further, third parties may use Tracking Technologies with MasterHealth’s Platform. MasterHealth does not control those Tracking Technologies and MasterHealth is not responsible for them. However, User consents to potentially encountering third party Tracking Technologies in connection with use of MasterHealth’s Platform or Services and accepts that MasterHealth’s statements under this Privacy Policy do not apply to the Tracking Technologies or practices of such third parties. User should check the third party websites to confirm how User’s information is collected and used.


MasterHealth obtains User’s consent to MasterHealth’s information storage or collection Tracking Technologies by providing User with transparent information in MasterHealth’s Privacy Policy and providing User with the opportunity to make a choice to disable cookies as set forth above. Please note that MasterHealth is not required to obtain User’s consent to the information collection Tracking Technologies identified above that is strictly necessary for the use of the Service. User has the right to object to other use of information storage or collection technologies.


Various third parties are developing or have developed signals or other mechanisms for the expression of consumer choice regarding the collection of information about an individual consumer’s online activities over time and across third-party web sites or online services (e.g., browser do not track signals). Currently, MasterHealth does not monitor or take any action with respect to these signals or other mechanisms.


Information Third Parties Provide About User

 

MasterHealth may, from time to time, supplement the information MasterHealth collects directly from User at the Platform and through Services with outside records from third parties for various purposes, including to enhance MasterHealth’s ability to serve Users, to tailor MasterHealth’s content to Users and to offer User opportunities that may be of interest to Users.


Third Party Credential Information. If you provide your third-party account credentials to us (for example, when you use our application, your log-in credentials for certain third party sites), you understand some content and/or information in those accounts (“Third Party Account Information”) may be transmitted into your account with us if you authorize such transmissions, and that Third Party Account Information transmitted to our Services is covered by this Privacy Policy; for example, avatars, profile information, images, friends and other authorized information. Certain information may be required to register with us or to take advantage of some of our features. The third-party that maintains your account credential may provide you with the option to change your log-in credentials or disconnect them from the Services. In addition, MasterHealth may provide third-party sites’ interfaces or links on the Platform and Services to facilitate User’s sending a communication from the Platform and Services. For example, MasterHealth may use third parties to facilitate emails, text messages, blog postings, tweets or Facebook postings. These third parties may retain any information used or provided in any such communications or other activities and these third parties’ practices are not subject to MasterHealth’s Privacy Policy. MasterHealth may not control or have access to User’s communications through these third parties. Further, when a User uses third-party sites or services, the User is using their services and not MasterHealth’s services and they, not MasterHealth, are responsible for their practices. User should review the applicable third-party privacy policies before using such third-party tools on MasterHealth’s Platform.


How do we use your Personal Information?


MasterHealth may use User’s information that MasterHealth collects about User for the following purposes: to provide the Services; billing purposes; to enable User to participate in a variety of the Service features; to contact User to inform User of new Services, products, offerings, service announcements, features, or news or articles MasterHealth thinks will be of interest to User, MasterHealth may send User regular updates on issues MasterHealth thinks will be of interest to User; to contact User with regard to User’s use of the Services and, in MasterHealth’s discretion, changes to the Services and/or the service policies; to improve the Services; for purposes disclosed at the time User provides User’s information or as otherwise set forth in this Privacy Policy; to provide User with information or services or process transactions that User has requested or agreed to receive including to send User electronic newsletters; to provide User with marketing materials or relevant advertising, promotions and recommendations from MasterHealth or our business partners; to process User’s account registration, including verifying User’s information is active and valid; to identify User as the author of any comments that User sends to MasterHealth to be posted on the Platform; to ensure that content on the Platform is presented in the most effective manner for User and for User’s computer or mobile device; and to provide User with access to User’s personal account. You can opt out of receiving commercial electronic messages, other than those that we may continue to send under applicable law or which are required to provide you with the Services by sending an email to [email protected].


Use of De-identified Information. We may de-identify personal information (including to anonymize personal information (de-identification where it is reasonable to expect that the User cannot be identified from the information in issue including when combined with information from sources otherwise available) or to pseudonymize it, or to de-identify personal information as otherwise permitted by applicable law). De-identified information may be used for any internal business purpose including research purposes and to improve the Services, and as otherwise permitted by applicable law. It may also be disclosed to third party service providers, to provide and improve the Services. We may also disclose De-identified Information to third parties, including advertisers and partners, for purposes including, but not limited to, targeting advertisements. Masterhealth may use de-identified information to provide feedback and information to authors upon which the programmes and Services are based and to compile statistics and databases for measuring and assessing the Services and other analytical purposes.


User can always opt out of utilizing the Service, and accordingly opt out of MasterHealth’s use of User’s Personal Information, by submitting a request via https://masterhealth.care/contact/ and including either the email address or phone number associated with your account.


How and When Does MasterHealth Disclose Information to Third Parties?


Except as set forth in this Privacy Policy or as specifically agreed to by User, MasterHealth will not disclose any information MasterHealth gathers from User on MasterHealth’s Platform and Services. Except as set forth in this Privacy Policy, MasterHealth does not share User’s Personal Information with third parties for those third parties’ direct marketing purposes. MasterHealth may provide to third parties information about User that does not allow User to be identified or contacted, including where such information is combined with similar information of other users of MasterHealth’s Platform and Services. For example, MasterHealth might inform third parties regarding the number of unique users who visit and/or use MasterHealth’s Services, the demographic breakdown of the registered users of MasterHealth’s Services, or the activities that users engage in while on MasterHealth’s Platform.


We may disclose personal information as necessary for processing payment of fees and charges for the Services and for collection purposes.


Personal Information may occasionally be transferred to third parties who act for MasterHealth for further processing in accordance with the purposes for which the data was originally collected or for purposes to which User has subsequently consented. For example, sometimes a third party may have access to User’s Personal Information in order to support MasterHealth’s information technology, to handle mailings on MasterHealth’s behalf, or for processing payments. If MasterHealth transfers User’s Personal Information to an outside agent or organization for such purpose, MasterHealth will take appropriate measures in an effort to protect User’s privacy and the Personal Information MasterHealth transfer. Personal information may be transferred to the United States where it may be stored or processed.


MasterHealth may share your Personal Information with various business partners. Some of these business partners may use your personal information to facilitate the offering of services or products that may be of interest to you. We may also share your Personal Information as otherwise described to you at the time of collection.


MasterHealth may, in MasterHealth’s sole discretion, share or transfer Personal Information where permitted or required by law, to comply with legal process, to interact with anti-fraud databases, to protect User’s vital interests, to protect the security or integrity of MasterHealth’s databases or the Platform, to enforce the Service Terms or protect the business or reputation of MasterHealth, to take precautions against legal liability, to protect and defend the rights or property of MasterHealth, for required institutional risk control, or for resolving disputes, inquiries or complaints with respect to User’s use of the Platform or Services.


We may also share your Personal Information in connection with or during negotiation of any merger, financing, acquisition or dissolution transaction or proceeding involving sale, transfer, divestiture, or disclosure of all or a portion of our business or assets. In the event of insolvency, bankruptcy, or receivership, Personal Information may also be transferred as business asset. If another company acquires our company, business, or assets, that company may possess the Personal Information collected by us and will assume the rights and obligations regarding your Personal Information as described in this Privacy Policy.


MasterHealth may offer you access to certain features, products, and/or services of third parties (the “Third Party Services”). We will disclose personal information that you request us to disclose to the Third Party Services provider, either by making the request directly via our Platform or indirectly if you expressly authorize the Third Party Services provider to request the personal information from us. Any disclosure of personal information shall be governed by the privacy policies of the Third Party Service provider and we will not have any ongoing duty or liability with respect to uses or disclosures by the third party once the personal information has been disclosed as per your request.


What About Information User Discloses Publicly or to Others?


User Content. “User Content” is any content, materials or information (including without limitation, any text, information, graphics, photos, musical works and sound recordings, images, data, questions, comments, suggestions, feedback, or other content, including personal information that you upload, send, email, display, perform, distribute, post or otherwise transmit to us, at our request or on your own, on, or through the Services or the Platform (such as community-based question and answers), whether in connection with your use of the Services or through the use of any third party websites or Third Party Services or otherwise, and whether publicly posted or privately transmitted.


MasterHealth does not control who will have access to the information that User chooses to make public, and cannot ensure that parties who have access to such publicly available information will respect User’s privacy or keep it secure. MasterHealth is not responsible for the privacy or security of any information that User makes publicly available on the Services, the Platform, or what others do with information User shares with them on the Platform App. MasterHealth is not responsible for the accuracy, use or misuse of any User Content that User discloses or receives from third parties through the Services. MasterHealth or others may store, display, reproduce, publish, distribute or otherwise use User Content online or offline in any media or format (currently existing or hereafter developed) and may or may not attribute it to User. Users will be provided the option at their discretion to invite and appoint other known individuals in their life as Motivators as well as to browse, create and/or join a Pod, which are small, private groups of Users within the Services; these appointed Motivators and other Users in a Pod will have access to certain User Content and may have the ability to share it with third parties. Please think carefully before deciding what information User shares, including Personal Information, in connection with User’s User Content.


Name and Likeness. MasterHealth may publish Personal Information that is part of User’s User Content, and MasterHealth may use the content, or any portion of the content, for advertising, marketing, publicity and promotional activities, provided that MasterHealth will not exercise such rights as to any User Content which identifies User in a public manner unless User provides a separate consent to MasterHealth in writing (email is sufficient) authorizing such use. For full terms and conditions regarding User Content User submits to the Service, please review the Service Terms.


Profiles. MasterHealth provides User the option, at User’s sole election, to upload a profile image and information that is viewable by other participants of the Services, but this is not mandatory. User may delete User’s profile picture and information at any time by logging into the App and visiting the profile settings page. A User’s profile page may be, by default, also be set up to display information such as the User’s display name, headline, description, web link, images, location (city/state/country), how many people the User has helped achieve their goal acting as a Third Party Challenge Host, how many challenges they’ve completed and activities they’ve logged, how many friendships they’ve made as well as making available a visible list of those friendships for browsing by others, groups that the User has joined and optional information added by User. Profile information is used by MasterHealth primarily to be presented back to and edited by User when User accesses the Service and to be presented to others permitted to view that information on the Service. It is considered to be information that MasterHealth can make publicly available including to search engines. MasterHealth may offer Users the ability to manage their public profile and use profile preference settings, the functionality and features of which are subject to change from time to time, so visit it frequently to confirm the settings reflect User’s then current preferences and MasterHealth recommends that User does not post information or content as part of User’s profile that User is not prepared to make public. Changing setting options may not result in immediate changes to the settings, which are subject to MasterHealth’s operations and maintenance schedules. User should carefully consider the use of such settings to improve information display options and to ensure the settings are properly set and functioning in the manner desired. Notwithstanding the availability of profile preference settings, User should be aware that these settings are for convenience only, do not employ complex data security protection and may not be error free. Further, other Users that have access may repost or otherwise make public User’s information or content. Accordingly, discretion and good judgment should be exercised when posting information or content as part of User’s profile.


Opting Out. You may choose not to receive future promotional, advertising, or other Service-related notifications from us by changing the notification settings on your Device. If you choose not to receive notifications, you may still use the Service but you may not receive, or may be unable to use, certain programmes or Services that involve our interaction with you. At all times, you may choose whether or not to provide or disclose Personal Information. If you choose not to provide the Personal Information we request, you may still use the Service, but you may be unable to access certain programmes or Services that involve our interaction with you.


How we collect, disclose and use Personal Information in Free and Paid Challenges

 

Invitations to Challenges. When a User creates and shares a Challenge (the “Challenge Host”), we will share their display name and/or their full name if provided, profile photo, sharing introduction message, and Challenge commitment with those invited and all Users who join their Challenge (“Challenge Participants”). This information will be shared with and can be seen by anyone who clicks on the Challenge Host’s share link. Challenge Participants in a Free Challenge may openly share that Challenge with others, which includes information about that User as well as the Challenge Host described above; certain Third Party Paid Challenges, at the option of the Challenge Host, may restrict the ability for Challenge Participants to share a Challenge more broadly. This information may be displayed on our Website and Apps.

 

Challenge Discovery. This service, offered to Challenge Hosts, enables other MasterHealth users and prospective users to discover and join these Challenges via our Platform and Services , and to be marketed and advertised by us in places including but not limited to our MasterHealth communities and distribution lists such as those found in imobile apps, website, by email and on social media. By opting into using this service, you expressly consent to our sharing of your information in these ways. Only certain Challenges may be eligible for inclusion, based upon the then determined criteria by MasterHealth.

 

Joining and Participating in a Challenge. By joining a Challenge, you agree to share with all other participants in that Challenge, all information in your User Profile, your challenge commitment, and challenge performance. When you choose to join a Challenge, we may share this information with others in the same Challenge as well as individuals who have become your friends (as described below) who may or may not be yet participating in the challenge with you. When you log an action as part of a Challenge, a record of that event will be shared in the Challenge group chat visible by everyone in that Challenge; in addition, your in-challenge profile and activity card will show your overall percentage completion of the Challenge to everyone, and show your total logged activity within the challenge to your MasterHealth friends. By joining a Challenge, you will become part of a Challenge Group Chat, where you may choose to share messages, photos, videos and reactions to all message types. Any information you share will be visible to everyone who is participating in the challenge, including anyone who you may have blocked as a MasterHealth Friend. Your Challenge Host will have access to reports that include your Challenge pacing, streaks and overall progress during a Challenge and after it is completed.

 

Real-Time Person-to-Person Chat with Challenge Host. Each Challenge Participant who joins a Free or Paid Challenge agrees to be put into a real-time, person-to-person chat with the Challenge Host to ensure that the Challenge Host can run the Challenge and fulfill their services to you as part of any Paid Challenges that you may join. This real-time space enables you and the Challenge Host to privately share messages, videos, photos, links, and conversations.

 

Establishing MasterHealth Friend Connections. When you invite someone to a Challenge and the person accepts via your invite link, they may in some cases automatically become a Friend of yours on the MasterHealth Friend graph. While in a Challenge, you will see everyone in that Challenge even if they are not friends of yours; either party may make a friend request within the Challenge by tapping on the appropriate icon, and a friend request will be sent to the other person. The recipient of the friend request may accept or decline the request. However if the person declines the request, MasterHealth will provide the recipient the option to block all future friend requests made by the sending person to curb abuse within the system. You may tap on the Friends section of the User Profile to see someone’s list of MasterHealth Friends. When you browse someone else’s User Profile, you will have the options to add friends, unfriend others, or cancel a pending friendship request. When you browse your own User Profile, you will have an option to Unfriend those you have connected with in the past.


Earning and Redeeming Rewards. As part of using Challenges, you may unlock rewards and savings. In some cases, we may ask you to share your Personal Information with us or with select partners in order to validate your identity across both services so that we can provide you with the ability to redeem the rewards that you’ve earned.

 

How long do we keep your Personal Information?


We retain your Personal Information only as long as we require it to provide the Services to you and to maintain an appropriate historical record of our relationship with you. If there are legal or business requirements relating to the period of time which we must retain your personal information, we comply with those requirements. We may retain de-identified information (as defined herein) indefinitely.


Uninstalling the Mobile App


You can stop all collection of Personal Information by our App by uninstalling the App. You may use the standard uninstall processes as may be available as part of your mobile device or via the App marketplace or network.

 

Correction and Review of Personal Information


Upon receipt of User’s written request and upon MasterHealth’s receipt of enough information to permit MasterHealth to identify User’s Personal Information, MasterHealth will disclose to User the Personal Information MasterHealth holds about User. MasterHealth will also correct, amend or delete any Personal Information that is inaccurate and notify any third party recipients of the necessary changes. User may update any information User has given to MasterHealth by sending an email to [email protected]. Requests to delete Personal Information are subject to any applicable legal and ethical reporting or document retention obligations imposed on MasterHealth.


Links to Other Websites

 

The Service may contain links to third party websites that are not owned or controlled by us. We are not responsible for the privacy practices or the content of such other third party websites, and you visit them at your own risk.


Children’s Privacy

 

The Service is neither directed to nor structured to attract children under the age of 13 years. Accordingly, we do not intend to collect Personal Information from anyone we know to be under 13 years of age. We will direct potential users under 13 years of age not to use the Service. If we learn that Personal Information of persons less than 13 years of age has been collected without verifiable parental consent, then we will take the appropriate steps to delete this information. Notice to California Residents


If you are a California resident, California law may provide you with additional rights regarding our use of your personal information.


If you are a California resident, this section also applies to you and supplements the information contained elsewhere in this Privacy Policy. The California Consumer Privacy Act (“CCPA”) gives California residents certain legal rights to understand the personal data collected about.

 

California Online Privacy Protection Act Notice


On September 27, 2013, California enacted A.B. 370, amending the California Online Privacy Protection Act to require certain operators to disclose how they respond to “Do Not Track Signals”; and whether third parties collect personally identifiable information about users when they visit sites. (1) We do not track users, who do not interact with its sharing functionality across the web, and therefore do not use “do not track” signals. (2) We do not authorize the collection of personally identifiable information from our users for third party use through advertising technologies without separate member consent.


California Civil Code Section 1798.83 also permits our customers who are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, please send an email to [email protected]. Please note that we are only required to respond to one request per customer each year.


Please review this for an explanation of the rights that may apply to you. In addition to those rights in this Section, you may also request certain information regarding the disclosure of your personal information by us and our related companies to third parties for the third parties’ direct marketing purposes. We do not disclose your personal information to third parties for their own direct marketing purposes.


MasterHealth Service: International Users


MasterHealth’s Service is currently operated in Canada and the United States.
